1. Acceptance of Terms

By accessing or using GumbalUp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including quiz hosts, participants, and organization administrators.

2. Account Registration

To create quizzes and host sessions, you must register for an account with accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. Participants may join quiz sessions without creating an account.

3. Subscriptions & Billing

GumbalUp offers free and paid subscription plans. Paid plans are billed on a monthly or annual basis. You may upgrade, downgrade, or cancel your subscription at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the end of the current billing period. Refunds are available within 14 days of initial purchase if you are unsatisfied with the service.

4. Acceptable Use

You agree not to use the Service to:

• Create content that is illegal, harmful, or violates the rights of others
• Distribute malware or attempt to gain unauthorized access to the Service
• Impersonate any person or entity
• Interfere with or disrupt the integrity of the Service
• Use automated tools to scrape, crawl, or extract data from the Service
• Resell or redistribute the Service without authorization

5. Content Ownership

You retain ownership of all quiz content, questions, and materials you create on the platform. By using the Service, you grant GumbalUp a limited license to host, display, and distribute your content solely for the purpose of providing the Service. AI-generated quiz content is owned by you upon generation.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with advance notice. We reserve the right to modify or discontinue features with reasonable notice. For paid plans, we target 99.9% uptime.

7. Limitation of Liability

To the maximum extent permitted by law, GumbalUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability for any claim arising out of or relating to these terms shall not exceed the amount paid by you in the 12 months preceding the claim.

8. Organization & Multi-Tenancy

Organization administrators are responsible for managing member access and roles within their organization. Organization data is isolated and not accessible to other organizations. Admins may assign host and participant roles to members. Removing a member does not delete their historical quiz participation data.

9. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the revised terms.
